Terms and Conditions of Sale

These Terms and Conditions of Sale concern the purchase of products on the website www.beltalia.it, from BELTALIA Srl, with headquarters in Camposampiero (PD), in Via Borgo Trento Trieste, 33/5 – 35012, VAT no. 04991260284.

The purchases are governed by Italian Legislative Decree no. 185 of 22/05/1999 “Implementation of Directive 97/7/EC on the protection of consumers concerning distance contracts” and, as regards the protection of confidentiality of personal data, by Law no. 675/96 as amended.

Subject and conclusion of the agreement

The purchase agreement between the Customer and Beltalia is concluded exclusively by the Customer on the website www.beltalia.it, where, following the indicated procedures, the Customer formalises the purchase of the goods offered for sale.

The purchase agreement is concluded

• with the completion and submission by the Customer of the order form, which shall be displayed on the order summary web page listing the details of both the purchaser and the order, the price of the goods purchased and the terms and payment procedures to choose from.
• E-mail is used for any additional services or special requests.

When Beltalia receives the order from the Customer, it shall issue an e-mail confirmation and/or display a printable web page confirming the order. The sales invoice is issued only if the customer requests it during the purchase and shall be sent to the customer in digital format by email.

By placing an order, the Customer declares to have read all the information provided to him/her during the purchase procedure and accepts the Terms and Conditions of Sale and payment set out on the website www.beltalia.it.

For single mattresses with a width of more than 100 cm and double mattresses with a width of 180 cm and a length of more than 200 cm, Beltalia may have to glue on components of the same shape, colour and material that do not in any way affect the functionality, durability or quality of the product.

Processing of the order

Orders are processed:

• For payments by bank transfer: upon receipt of the bank’s confirmation of the transfer by the customer.
• For payments via Credit card and PayPal: upon receipt of payment.

Limitation of liability

Beltalia assumes no liability for circumstances beyond its control that prevent it from executing the order within the time stipulated in the agreement. Beltalia cannot be held liable by the Customer, except in cases of wilful misconduct or gross negligence, for disruption or malfunctions related to use of the Internet beyond its or its sub-contractors’ control. Furthermore, Beltalia shall not be liable for any damages, losses or costs incurred by the Customer as a result of non-execution of the contract due to causes not attributable to it. Where applicable, the customer is entitled to the cost of the purchased product and not the services provided. Beltalia assumes no liability for any fraudulent or unlawful use by third parties of credit cards at the time of purchase.

Defect liability, proof of damage and damages payable: seller’s obligations

No compensation shall be payable if the damaged party was aware of and wilfully ignored the defect and the resulting danger. In any case, the damaged party must demonstrate the existence of the defect and the damage and the causal relationship between the two. The damaged party may seek compensation for damages caused by death or personal injury or the destruction or deterioration of items other than the defective product, provided they are of a type ordinarily intended for private use or consumption, and so mainly used by the damaged party. Beltalia assumes no liability for problems due to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other events that prevent, in whole or in part, implementation of the sales agreement within the agreed time. Beltalia shall not be liable to any party for damages, losses or costs incurred as a result of failure to execute the sales agreement for the above-mentioned reasons, or for any damages, losses or costs incurred as a result of the use or inability to use the purchased products as the customer is only entitled to a refund of the price paid for the goods only, excluding shipping charges and any additional services purchased. Likewise, Beltalia shall not be liable for any fraudulent or illegal use of credit cards by third parties upon payment of the purchased products.

Customer’s obligations

The Customer shall pay the price of the purchased goods and ancillary services in the time and manner specified in the Agreement. After completing the on-line purchase procedure, the Customer shall print and save the web page listing the order data.

Prices of customised mattresses and frames are valid only and exclusively for products with a width of between 80 and 180 cm and a length of between 180 and 200 cm.

Please note that there is a 3% tolerance on the dimensions of standard and customised products.
