Can I cancel a purchase order?

Except where the ordered product must be made to specific requirements (i.e. where it is custom made), it is possible for you to withdraw from the purchase agreement and, therefore, cancel an order for any product, for any reason, at any time, as of the date on which the order was placed, up to 14 working days after the date of receipt of such product, in accordance with Italian Legislative Decree no. 206/2005.

Purchases are governed by Italian Legislative Decree no. 185 of 22/05/1999 “Implementation of Directive 97/7/EC on the protection of consumers concerning distance contracts” and, as regards the protection of confidentiality of personal data, by Italian Law no. 675/96 as amended.

How can I return the product?

To exercise the right of withdrawal you must send notice within 10 working days of receipt of the products for which you are exercising the right of withdrawal. This notice must be sent by registered letter with return receipt, addressed to BELTALIA srl, Via Borgo Trento Trieste, 33/5 – 35012 Camposampiero (PD, Italy), or in advance by e-mail or fax within the said period of 10 days and followed by confirmation by registered letter with return receipt to be sent within the following 48 hours and no later. Upon receipt of the notice of withdrawal, the Customer will be given the instructions on how to return the product, according to the terms and procedures below.

The right of withdrawal applies only to the product purchased in its entirety; you cannot exercise withdrawal only for one or more parts of the product purchased. In the case of orders consisting of several products, you can exercise the right of withdrawal for one or more products of the order, giving a description of the products you intend to return in the notice of withdrawal, as per the preceding paragraph.

The notice must clearly indicate:

1. Written and signed statement in which the purchaser states he/she wishes to exercise his/her right of withdrawal
2. Copy of the order
3. Name of the item(s)
4. Details of the bank account on which to obtain the transfer (ABI – CAB – IBAN Bank Account). If the purchaser does not have any personal bank details, he/she can provide those of a family member or acquaintance, authorising Beltalia to credit the amount there
5. The e-mail address and phone number Beltalia must use to communicate the status of the returned product

When the right of withdrawal is exercised in writing within 14 days of receipt of goods, the purchaser must await subsequent confirmation from us before proceeding with shipment.

The goods being returned must be kept in their original package or properly repacked, and must be sent by a trustworthy carrier no later than 14 days from the date of receipt of the goods. Shipping costs for returns are at your expense.

If exercising the right of withdrawal:

• We shall refund as soon as possible and, in any event, within 30 days from the withdrawal, all amounts already paid by the customer in relation to the purchase price of the product (the cost for returning the product to Beltalia headquarters shall be at the purchaser’s expense);
• the product must be returned according to our conditions of return, which are provided below
• you are legally obliged to take reasonable care of the product until the moment you return it.
• if you wish to withdraw from the purchase agreement before the product has been delivered, please contact us at the address listed on the website (however, if the order has already been processed for delivery, we may not be able to prevent delivery of the product).
• If you wish to exercise the right of withdrawal after receiving the product, Beltalia has the right to ask you not to use the product and not to remove the original packaging, or to ask, if such packaging has already been removed, for the product to be returned with the original packaging.
• orders may only be made and cancelled once. The same product cannot be re-ordered.
• the evaluation terms are valid once only for each delivery address (see more under Changing a Product)
• The possibility of exercising the right of withdrawal is forfeited when the product (packaging and/or its contents) is not in perfect condition, in cases where: even partial use of the product is established; integral parts of the product are missing; the product is damaged by causes other than its transport. In such cases, the products shall remain in storage at our warehouse for the customer to collect at his/her expense.

How will I obtain a refund of my return?

Any refund to the Customer, if he/she is entitled to it, shall be credited by payment reversal, at the latest within 30 days from the date on which Beltalia became aware of the cause giving rise to the right to reimbursement.

Refund of amounts paid shall be made within 30 days of receipt of the notice of withdrawal (Article 5, paragraph 6 of Italian Legislative Decree no. 185 of 22/05/1999). The consumer has the right to withdraw without penalty, after verifying the integrity of the product. The only costs to be borne by the customer are those concerning the return of the product and not the original shipping costs sustained by the supplier.

Reimbursement shall be made by bank transfer to the account specified in the registered withdrawal letter, as indicated above.

N.B. As per art. 5 comma 3 and art. 7 of Italian Law 185/99 goods made to measure or customized during the ordering process are excluded from the exercise of the right of withdrawal.

WARNING – Products that are damaged or improperly packaged and not in their original packaging shall not be refunded, and shall be returned to the sender who shall have to sustain the relative shipping costs.

Conditions for return of goods

If you wish to return a product, it is necessary to send an e-mail to info@beltalia.it with the subject “I wish to make a return”.

The item to be returned must be returned at the customer’s expense to the address indicated in the order confirmation.

Without prejudice to the provisions of the paragraph above, Beltalia reserves the right, at its own discretion, to cover shipping expenses paid by the customer should the reasons for returning the product be attributed to Beltalia.

The applicant shall ensure that all products packaged for return are clearly labelled with his/her name and mailing address. He/she shall also keep the shipping receipt and send it by e-mail to info@beltalia.it.

Changing a product

After receiving the product, in addition to the 14 days provided for withdrawal, Beltalia gives the purchaser the opportunity to evaluate the product received for another 16 days (i.e. up to a month – or 30 days) after receiving the product.

If he/she so wishes, the customer may change the purchased Beltalia product within 30 days of receipt. In which case:

• the customer sends us an e-mail indicating that he/she would like to change the product
• Beltalia replies with confirmation
• the customer sends the product at his/her expense, with its original packaging. Beltalia shall check that the product is in good condition and is not damaged or deteriorated. If the product is in good condition, Beltalia shall send a voucher having the same value as the product (excluding shipping costs, any ancillary services, or other costs) which can be used to choose other products from the Beltalia website. This voucher is valid for six months, and may also be used for more than one order. The voucher shall be sent with instructions on how to use it.

Use of the products

The purchaser agrees to use the products only for normal and proper use and not to alter or modify or otherwise tamper with them.

The purchaser agrees to follow the manufacturer’s instructions provided with the product and not to use the products in an incautious or negligent manner.

Beltalia’s tolerance of any default or breach of these terms by the purchaser does not imply nor can be considered or construed as a waiver by Beltalia to exert its legal rights against the purchaser in relation to such default or breach or a waiver to protect its interests and rights according to law.

IMPORTANT – Please read these terms and conditions carefully as they form an agreement that is legally binding between the customer and Beltalia srl. Persons who do not accept these Terms and Conditions are requested not to place orders via the Website.
